There ain’t no rules here, we’re trying to accomplish something. . . .All this talk about rules. . . .When the deal goes down . . . we make ‘em up as we go along.
—Rep. Alcee Hastings (D-FL), a disgraced former judge who was impeached (by a Democrat Congress) for taking bribes.
Hat Tip to Hot Air.
Rep. Mike Pence (R-IN) lashed out at Democrats’ violating their oaths to support and defend the Constitution in their effort to bypass a floor vote for ObamaCare.
“The Democrat health care bill that’s being brought through the Congress this week is nothing more than a government takeover of health care, and the American people know it. I know the administration doesn’t like us to use that phrase, but come on.
When you mandate that every American purchase health insurance whether they want it or need it or not, you mandate that every business provide it, you create a massive government-run bureaucracy exchange that mandates what’s in insurance plans, you wrap that all in about $1 trillion worth of spending, that’s a government takeover of health care.
“But what’s really remarkable about this whole business is that not only the American people rejected this plan but Democrats are so desperate to pass it that they’re willing to trample on the traditional rules of the House and Senate and even trample on the Constitution of the United States to get it done.
“The Constitution provides that a bill becomes a law if it’s passed the House of Representatives and the Senate. Democrats actually don’t have the votes to pass the Senate bill, so they’ve decided they’re going to try and pass the bill without a vote.
“Well that would be news to the Founders of this country, and a betrayal of the commitment of every Member of this Congress to the American people. I urge the Speaker, if you have the votes for the Senate bill, bring it to the floor. If you don’t, let’s scrap the bill and start over for the American people.”
Hat Tip to Big Government.
House leaders are preparing to ram through ObamaCare this week without a vote. Not only is the legislation unconstitutional, but the process being used to pass it is unconstitutional. The House is preparing a rule that would consider the Senate-passed version of ObamaCare passed in the House even though members would never directly vote on it. That would violate Article 1, Section 7 of the U.S. Constitution.
Here is how the trick would work: In the House, the Rules Committee sets up the parameters for debate on legislation. House leaders are considering a complicated rule that would be structured so that a vote on the rule setting down the structure for the ObamaCare debate would allow the Senate’s version of health care reform to pass without a vote. First, there would be a vote on a rule. If the rule is passed by the House, then the House would vote on a health care budget reconciliation measure that is an amendment to the Senate passed ObamaCare bill. If that reconciliation measure passes, then reconciliation goes to the Senate and the ObamaCare legislation is deemed passed without a direct vote. The plan for the legislation is unclear. House leadership will either structure the rule to either immediately present ObamaCare to the President for his signature or they will hold the bill and deliver it only if the Senate passes a health care reconciliation measure. Either way, the Constitution and the American people are the losers.
Not only that but Harry Reid snuck this in the bill:
Senate Majority Leader Harry Reid of Nevada is proving once again the maxim that darkness hates the light.
Buried in his massive amendment to the Senate version of Obamacare is Reid’s anti-democratic poison pill designed to prevent any future Congress from repealing the central feature of this monstrous legislation.
Beginning on page 1,000 of the measure, Section 3403 reads in part: “… it shall not be in order in the Senate or the House of Representatives to consider any bill, resolution, amendment or conference report that would repeal or otherwise change this subsection.”
In other words, if President Obama signs this measure into law, Reid intends that no future Senate or House will be able to change a single word of Section 3403, regardless whether future Americans or their representatives in Congress wish otherwise.
Note that the subsection at issue here concerns the regulatory power of the Independent Medicare Independent Advisory Board to “reduce the per capita rate of growth in Medicare spending.”
That is precisely the kind of open-ended grant of regulatory power that effectively establishes the IMAB as the ultimate arbiter of the cost, quality and quantity of health care to be made available to the American people. And Reid wants the decisions of this group of unelected federal bureaucrats to be untouchable for all time.
The American people are getting angrier by the day over the Dem’s hubris. We do not want government seizure of our healthcare, yet these fucking megalomanics are hellbent on shoving ObamaCare down our throats. They are attempting to “pass” a bill which does not have enough votes to pass.
As the Tea Party protests grow to another fever pitch, the Democratic dictators in Congress and Senate had better take heed. They work for us, not the other way around. In their haste to grab as much power as they can, they’ve forgotten that public outrage is a lot more powerful.
Pelosi, Reid, Baucus, Hoyer, and the other tone deaf autocrats have the gall to stand at the podium and insist that they will pass this socialist economic train wreck, regardless of the consequences.
Come November they will hear us good and loud.
