For the uninitiated: Ricci v. DeStefano involved a reverse discrimination case. Leftwing activist Judge Sonia Sotomayor (aka “wise latina”) joined in a decision last year that rejected a claim that the City of New Haven, Conn. discriminated against white and hispanic firefighters by throwing out a promotional exam after all the black firefighters who took it scored too poorly to be promoted.
An excerpt from the Supreme Court decision:
Under Title VII, before an employer can engage in intentional discrimination for the asserted purpose of avoiding or remedying an unintentional, disparate impact, the employer must have a strong basis in evidence to believe it will be subject to disparate-impact liability if it fails to take the race-conscious, discriminatory action. The Court’s analysis begins with the premise that the City’s actions would violate Title VII’s disparate-treatment prohibition absent some valid defense. All the evidence demonstrates that the City rejected the test results because the higher scoring candidates were white. Without some other justification, this express, race-based decision making is prohibited.

Justice Kennedy wrote the majority opinion, along with Chief Justice Roberts and Justices Scalia, Thomas, and Alito. The liberal four Justices—Souter, Stevens, Breyer, and Ginsburg dissented.
Prior to this decision, she was overturned 60% of the time.
